Terms of service

1. Who we are

Agena at https://agentevents.xyz is operated by Curio Capital AG, Baarermattstr. 8b, 6340 Baar, Switzerland. These terms apply to the website, the newsletter, the feeds, the Open API, organiser API keys and sponsorship. Company details are on the imprint.

“We” means Curio Capital AG. “You” means the person or organisation using Agena. If you use Agena for a company, you confirm you may bind that company.

2. What the service is

Agena lists public events from organiser pages, Luma, Meetup, organiser calendars and direct submissions. Listings are refreshed daily and copied mostly by software. How that works is on the sources page.

Agena is not the organiser of any event it lists. We do not sell tickets, take registrations or run the event. Registration, cancellation, refunds, safety and the event itself are between you and the organiser. Always check the organiser's page before you travel. Rows marked “sample” are placeholders, not real events.

The service is new. Coverage and features will change, and a listing can be late, wrong or missing.

3. Using Agena

Browsing, the feeds, the calendar links and the Open API are free and need no account. The newsletter needs an email address you confirm by double opt-in. You can unsubscribe from every message. What we store is on the privacy page.

4. Submitting events and organiser API keys

When you submit an event, you confirm it is public, that the details are correct, and that you may share them. You allow us to publish, edit, shorten, tag and remove the listing, and to show it in feeds and the API. We review submissions and may refuse any of them.

An organiser API key is a bearer credential. We store only a hash of it, so we cannot show it again. Keep it out of query strings, pages and shared repositories. You are responsible for calls made with your key until you tell us it has leaked. We may revoke a key that breaks these terms.

5. Acceptable use

You agree not to:

• submit events that are false, unlawful, private, or not yours to share;
• bypass a rate limit, interfere with the service, or probe data that is not public;
• republish the catalogue as a competing listing service without crediting Agena and linking back;
• hide that a placement was paid for, or use Agena to send unlawful bulk email.

Using the Open API and feeds in your own tools and agents is welcome. Please credit Agena with a link.

6. Sponsorship

Paid placements are labelled “Sponsored by” or “Featured”. Prices and what each option includes are on the sponsor page. When online checkout is open, payment is taken by Stripe; we never see your card number. The price, currency and period shown at checkout are part of your order.

A label means the placement was paid for. It is not a recommendation. A sponsor does not buy a change to other listings or to the order of search results beyond the paid placement. The sponsor is responsible for its own claims. We may refuse or remove a placement that is misleading or unlawful. A placement that has started is not refunded, except where the law requires it.

7. Intellectual property

The site, its design, and the way we select and arrange listings belong to us. Event titles, descriptions and images stay with their organisers. You keep your rights in what you submit.

8. No guarantee of accuracy

Sources are incomplete and automated copying makes mistakes. A listing can show the wrong date, venue, price or city, or an event that was cancelled. We do not warrant that Agena is accurate, complete, current, or available.

9. Liability

To the extent Swiss law allows, we are not liable for slight negligence, for lost profit, or for costs you incur from relying on a listing, such as travel to an event that moved or was cancelled. We do not exclude liability for unlawful intent or gross negligence; an advance exclusion of that liability is void under Article 100 of the Swiss Code of Obligations. Where a cap is permitted, our total liability is limited to the fees you paid us in the twelve months before the claim, which for free use is zero.

10. Changes

We may update these terms as the service changes. The date at the top moves when we do. If you keep using Agena after an update, you accept the new terms.

11. Swiss law and the courts of Zug

These terms are governed by Swiss law, without its conflict-of-law rules. The courts of Zug, Switzerland, have exclusive jurisdiction, unless a mandatory rule gives a consumer another venue.
